Gil Rochbert

Bio

Gil practices in all areas of civil litigation, including automotive negligence, medical malpractice and complex wrongful death cases. Prior to joining the firm in 2015, Gil worked as a Law Clerk for the Justices of the Massachusetts Superior Court for two years. As a Law Clerk, Gil gained valuable experience drafting legal memoranda and judicial decisions, and working closely with the Justices on trials and motions. Gil brings the same dedication to justice he showed at the Superior Court to obtaining the best result for his clients. Gil is an active member of the Massachusetts Bar Association and the Massachusetts Academy of Trial Attorneys.

Representative Achievements

Successfully opposed in writing and at oral argument five summary judgment motions leading to $3,335,000 mediated settlement in wrongful death case involving a mulch fire at an apartment building.

Briefed an opposition to Communications Decency Act defense to demonstrate liability on the part of an online retailer in product liability case, leading to request for mediation and $720,000 settlement for eye injury to a child.

Successfully parsed terms of five automobile insurance agreements from three different insurers and prevented 1/4 of $423,000 settlement from being wrongfully withheld, by convincing insurers of correct proportionate share without having to file declaratory judgment action.

$450,000 mediated settlement for woman who fractured her arm and required multiple surgeries after she slipped and fell on ice at the entrance of a hotel. Settlement included negotiating large reduction in workers compensation lien.

$125,000 mediated settlement for rear-end automobile collision resulting in long-lasting radiculopathy and cervical pain. Following settlement negotiated $60,000 reduction in medical lien for client.

Authored the annual update to the MCLE Civil Trial Practice Manual chapter on Emotional Distress from 2016 through 2021.
